Please read these terms and conditions carefully. By placing an order, you agree to be bound by the terms below. If you have any questions, please contact us via the contact form on the site.

 

1. Application

These Terms & Conditions apply to all purchases made from Cove Bay Babies, operated by Roy Gullan, 4 Cove Walk, Aberdeen, AB12 3DY.
You must be at least 18 years old and legally eligible to enter into a contract. By clicking “I Accept” at checkout, you confirm agreement to these terms.

 

2. Interpretation

  • Consumer: An individual acting outside their trade or profession

  • Contract: The legally binding agreement between you and us

  • Goods: Handmade baby gifts, nappy cakes, personalised prints, and related items listed on our website

  • Order: Your submitted request to purchase Goods

  • Delivery Location: The address you provide for delivery

  • Durable Medium: Email or other storable format

  • Website: www.covebaybabies.com (or your final domain)

  • Privacy Policy: Our data handling terms

 

3. Goods

  • Descriptions and photos are illustrative; minor variations in size or colour may occur.

  • Measurements are provided to clarify scale.

  • Colours may appear differently on various screens.

  • Handmade items may vary slightly due to their crafted nature.

  • Availability is subject to change.

  • We may update listings to comply with legal or safety requirements.

 

4. Ordering & Contract Formation

  • Submitting an order does not guarantee acceptance.

  • A contract is formed only when you receive an Order Confirmation via email.

  • You are responsible for checking order details before submission.

  • We reserve the right to reject or cancel orders at our discretion.

  • Quotations are valid for 7 days unless withdrawn earlier.

 

5. Price & Payment

  • Prices are listed on the website. We are not VAT‑registered, so VAT is not charged.

  • Payment is required at checkout via debit or credit card.

  • Delivery charges are shown at checkout and may vary by location.

 

6. Delivery

  • All items are handmade to order and require 3–5 days to create before dispatch.

  • Once ready, orders are processed within 1–2 business days.

  • Delivery within Mainland UK, Highlands, and Northern Ireland typically takes 2–3 business days.

  • We do not ship to PO boxes.

  • We cannot ship to Germany due to local packaging regulations (VerpackG).

  • All parcels are sent tracked via Royal Mail.

  • USA tariffs are included in the shipping price and paid directly to Royal Mail.

  • We are not liable for postal delays, courier disruptions, or customs processing times.

  • International customers are responsible for any import duties or fees (except USA tariff arrangements).

  • If delivery fails due to customer error, we may charge for redelivery or storage.

  • Goods become your responsibility upon delivery.

 

7. Risk & Title

  • Risk passes to you upon delivery.

  • Ownership transfers only after full payment is received.

  • If payment is overdue or insolvency occurs, we may cancel delivery and request return of goods.

 

8. Cancellation & Returns

Handmade Items (Nappy Cakes, Prints, Personalised Gifts)

  • Handmade and personalised items are not eligible for return due to change of mind.

  • If an item arrives damaged, you must notify us within 3 working days with photographic evidence.

Cancellations

  • You may withdraw your order before the contract is formed.

  • Cancellations must be requested within 2 hours of payment.

  • If the order has already been processed or creation has begun, cancellation is not guaranteed.

  • If cancellation is not possible, the order will follow the applicable returns policy.

  • You may refuse delivery if cancellation is denied.

  • All cancellation requests must be submitted via the contact form.

 

9. Conformity & Guarantees

We have a legal duty to supply goods that conform to the contract.

For handmade items, this means:

  • They are described accurately.

  • Any variations due to handmade processes are normal.

  • No guarantees are offered beyond the description provided.

 

10. Privacy & Data

  • We comply with UK GDPR.

  • Your data is used only for order fulfilment and shipping.

  • A valid email address and telephone number are required for all orders.

11. Liability

  • We do not exclude liability for fraud, death, or personal injury caused by negligence.

  • We are not liable for indirect, incidental, or consequential losses, including loss of profit or business.

  • We are not liable for delays, customs issues, or third‑party courier failures.

  • We are not liable for faults or damage once goods are delivered, unless reported within 3 working days with photographic evidence.

 

12. Governing Law & Complaints

  • These terms are governed by Scottish law.

  • Disputes may be resolved in Scottish courts or your local jurisdiction.

  • We aim to respond to complaints within 5 working days.

  • All complaints must be submitted via the contact form.
